Terms of Service and Rental Appliance Lease Agreement
Quack Rentals agrees to rent or lease equipment to the individual customer. Customer agrees to be responsible for all rental payments to Quack Rentals.
Equipment Ownership: Customer acknowledges and agrees that all equipment rented or leased from Quack Rentals is the sole and exclusive property of Quack Rentals. Customer has no equity, ownership interest, or possessory interest in the equipment at any time.
Rental Payments: Customer agrees to pay the rental fees as follows:
- For a set of a dryer and washer: $54.99 per month plus local, state, personal property tax and processing fees. Total:61.30
- For only a washer: $27.50 per month plus local, state, personal property tax and processing fees. Total: $30.66
- For only a dryer: $27.50 per month plus local, state, personal property tax and processing fees. Total: $30.66
The monthly payment will be automatically deducted from the customer’s credit card every month per their request. Special programs such as a NEW set program may be offered, with different fees applicable. The customer will be informed of the specific terms and fees in the contract for the special promotional program.
Delivery and Transportation Fees: When scheduling a delivery with Quack Rentals, a one-time $20 delivery fee will be applied. However, we occasionally offer promotions where this fee may be waived. If you request delivery outside a promotional period, rest assured that the delivery fee is a non-recurring charge and will only apply to the initial delivery of your rented equipment.
Missed Appointment Fee: To ensure efficient service, please be present during your designated delivery time window. If you are unable to make the appointment, kindly notify us at least 6 hours in advance to avoid a $20 missed appointment fee. Our drivers will wait for a maximum of 15 minutes at their discretion. Thank you for your cooperation in maintaining timely communication.
Payment Authorization: Customer authorizes Quack Rentals to process the credit card on file for monthly payments through auto-pay. The first month’s payment is due 24 hrs before delivery.
Recurring payments: Subsequent payments are due on the same date of delivery every month. If the delivery date falls on the 30th or 31st of a month, and the subsequent month has fewer days (e.g., 28 days in February), the payment will be withdrawn on the last day of the month. However, if the payment date falls on a Sunday or holiday, the payment will be withdrawn on the preceding or following business day, depending on the customer’s bank.
Late Payment and Automatic Credit Card Processing: In the event of a late payment, Quack Rentals will make attempts to automatically process the outstanding amount using the credit card on file.
Authorization for Automatic Payment Attempts: By using our services and entering into an agreement with Quack Rentals, you authorize us to make these automatic payment attempts using the credit card information provided.
Customer Responsibility: It is the customer’s responsibility to ensure that the credit card on file is valid and has sufficient funds to cover the outstanding payment. If there are any changes to the credit card information, it is the customer’s obligation to update the details promptly.
Late Fees and Collection Actions: Late payment fees and additional collection actions may be applied in accordance with the terms outlined in the rental agreement and applicable laws.
Pro-Rate Policy: Quack Rentals does not prorate rental fees. If the customer chooses to have their machines picked up before the end of the billing cycle, no refund will be made for prorated days. The customer is responsible for the full rental fee for the entire billing cycle, regardless of the return date of the equipment
Late Payments and Insufficient Funds: If a payment is not successfully processed and is more than three (3) days late, the customer will be charged a $10.00 late fee. The customer authorizes Quack Rentals to automatically deduct any late payments, including late fees, via the credit card on file.
Payment Arrangement and Late Fees: If a past-due payment arrangement is declined, an additional fee of $10 will be applied to the outstanding balance. This fee aims to cover administrative costs incurred due to the declined payment arrangement.
Access for Equipment Retrieval: In the event that a customer’s account becomes 15 days past due, the customer agrees to provide access to Quack Rentals for the purpose of picking up the equipment owned by Quack Rentals. The customer understands that failure to grant access may result in further actions to recover the equipment.
Repossession Attempt and Trip Fee: If a repossession attempt is made, but a payment is subsequently made by the customer, a $20 trip fee will be applied to the customer’s past-due balance. This fee helps cover the costs associated with the unsuccessful repossession attempt.
Equipment Relocation: Customer agrees not to remove or relocate any equipment from its original delivery location without written authorization from Quack Rentals.
Customer’s Responsibility for Equipment: After installation, the customer is responsible for the equipment. If equipment goes missing, the customer has fourteen days to discover and return the equipment. After 30 days, the customer is responsible for payment of $500 per unit for the equipment, including all unpaid rents due. This amount will be charged to the customer’s credit card and/or sent to a collections agency. It is important to note that if the customer rents a NEW set on a special promotional program, the terms written on that specific contract will supersede this clause.
Reporting Missing Equipment: In the event of missing equipment and unsuccessful collection attempts, Quack Rentals will report the equipment as stolen to the authorities, pressing charges, and/or sending the matter to a collections agency.
Access for Unpaid Rental Amounts: In the event that the customer falls behind on rental payments, the customer agrees to provide access to their apartment/home to retrieve the rented equipment
Equipment Maintenance: Quack Rentals agrees to keep the equipment in satisfactory working order. Customer agrees to allow reasonable access to the equipment for repairs and maintenance.
Repairs or Replacements: Quack Rentals agrees to repair or replace the equipment if it is not working properly due to normal equipment usage.
Swaps and Maintenance: At Quack Rentals, we offer complimentary swaps and maintenance for your convenience. We take care of these services at no additional cost to you. However, we kindly request that you notify us in advance if you need to reschedule your appointment. A rescheduling fee of $20 will be charged for missed appointments without a 6-hour advance notice. Please call us promptly if you are unable to make it to your scheduled appointment. We appreciate your understanding and cooperation.
Minimum Age Requirement: We understand that unexpected circumstances may arise, preventing the account holder, who must be at least 18 years of age, from being present for scheduled maintenance. In such cases, we allow a friend or family member to represent you. However, we kindly request that the designated representative also be at least 18 years of age. This requirement ensures that the person acting on your behalf possesses the necessary maturity and responsibility to handle any tasks or decisions that may arise during the maintenance visit. Thank you for your cooperation and understanding.
Hold Harmless Agreement: Customer agrees to hold Quack Rentals harmless from all claims, liabilities, or legal actions involving the use of this equipment. Quack Rentals is not responsible for any damage caused by the equipment to the house, apartment, townhouse, or any neighboring property. This includes, but is not limited to, flooding, water leakage, damage to clothing, or any other items placed in the washing machine
Physical Harm or bodily injury: Quack Rentals shall not be liable for any physical harm or bodily injury involving the equipment. This includes, but is not limited to, any accidents, injuries, or damages resulting from the equipment malfunctioning, leaking water, or failing to operate as intended. It is the customer’s responsibility to exercise caution and take appropriate safety measures when using the equipment. Quack Rentals recommends following all safety guidelines, manufacturer instructions, and industry best practices to minimize any potential risks or injuries
Clearance and Responsibility During Delivery and Setup: Customer must provide sufficient clearance for washers and dryers during delivery and removal. It is recommended to have approximately a foot of clear space on each side of the machine to ensure adequate clearance. Quack Rentals is not responsible for any damage to walls or surrounding areas if adequate clearance is not provided. Customer acknowledges that Quack Rentals’ employees may need to move the machines and, therefore, it is the customer’s responsibility to ensure a clear path for Quack Rentals’ employees. If furniture or other items obstruct the path, the customer must move them to create a clear path. Quack Rentals is not responsible for any damage to the customer’s belongings or property caused by the movement of items during delivery and setup.
Supervision During Operation: Customer acknowledges that the machines should never be left unattended during operation. It is the customer’s responsibility to be present and aware of the machines when they are in use. Quack Rentals is not liable for any damage or incidents that occur due to unattended operation.
Flood Prevention and Mitigation: In the event of flooding or water leakage, customer agrees to turn off the machines at the hook-up and immediately clean up the water to prevent damage to the house or neighboring properties. Quack Rentals is not responsible for any damage to the customer’s or neighbor’s house, apartment, condo, or any other property caused by flooding or water leakage.
Care and Responsibility for Personal Items: Customer acknowledges that Quack Rentals is not responsible for any damage to clothing or any other items placed in the washing machine. It is the customer’s responsibility to follow appropriate laundry care instructions and check for any potential risks or damages before using the machines.
Weight and Floor Protection: The customer acknowledges that the machines can be heavy, weighing up to 180 pounds without water, and Quack Rentals’ employees may physically push them into place during delivery and setup. It is the customer’s responsibility to ensure that their floor is strong enough to withstand the weight of a dolly with the machine passing through or being manually pushed into place. If the customer has wood floors or easily scratchable flooring, it is advisable to use protective coverings on the floors before Quack Rentals’ arrival. Quack Rentals holds no liability for any damage caused to the customer’s flooring or property during the delivery and setup process.
Customer Obligation Upon Vacating: To ensure a smooth transition, schedule your pick-up appointment with Quack Rentals at least 3 days in advance. Failure to provide the minimum notice will incur a $20 fee for urgent arrangements. Promptly notify us and schedule the pick-up within the specified timeframe. Many customers opt for pick-up the day before their next billing cycle to avoid extra charges. Your cooperation enables seamless pick-up and appreciated service.
Protection of Personal Information and Communication: Quack Rentals maintains a strict policy of confidentiality and will not share your personal information with any third parties outside of Quack Rentals or its staff. However, customer agrees to provide contact information to Quack Rentals for the purpose of communication via email, phone calls to your designated home, work, and secondary contact numbers. Quack Rentals may utilize voice broadcast, SMS (text messages), or phone calls to keep you informed about important matters such as late payments, delivery confirmations, maintenance issues, or new promotions. By providing the secondary contact, you allow Quack Rentals to communicate with them regarding your billing and whereabouts in the event that we are unable to reach you directly. Rest assured, your information and communication will be handled with the utmost care and privacy by Quack Rentals. Additionally, we may also use alternative communication methods such as placing notices on your door or sending mail to convey important information.
Minimum Rental Term and Cancellation: You are required to rent the machines for a minimum period of 3 months. After the initial 3-month term, the rental will continue on a month-to-month basis until you choose to cancel the service. If you need to cancel the service before the minimum term expires, you will be charged for the outstanding balance due for the minimum term as stipulated in the agreement. Please note that any cancellations must be made in accordance with the agreed-upon notice period outlined in this agreement.
Right to Refuse Service: Quack Rentals reserves the right to retrieve its equipment and cease doing business with any customer without notice for any reason. Examples include the following: rude or disrespectful behavior towards our staff, failure to make rental payments in a timely manner, or previous instances of being a problematic customer. We strive to maintain a positive and respectful working relationship with all our customers, and we expect the same level of professionalism and courtesy in return. Whether it is unpaid rents, a history of problematic behavior, or displaying rudeness from the start, Quack Rentals reserves the right to refuse service. In cases where a customer exhibits behavior that is deemed inappropriate or fails to meet their payment obligations, Quack Rentals may take necessary actions, including equipment retrieval and termination of the rental agreement.
Proper Machine Usage: Normal wear and tear is expected with laundry machines. However, damages resulting from misuse, such as overloading with items like comforters or washing diapers, are not covered. Damages like dried soap damaging the paint, attempted modifications, or unsanitary conditions attracting pests are considered misuse. You will be held responsible for the cost of the machine if such damages occur. Repairs, if possible, will be charged to your credit card. Please use the machines responsibly to ensure a smooth laundry experience.
Entire Agreement and Amendments:This agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings, whether written or verbal, relating to the rental of the equipment. Quack Rentals reserves the right to occasionally modify its terms and conditions for the purpose of further clarification or to adapt to changes in how the business operates. If there are any changes to the terms of service, we will notify you by email to the email address listed in your account.
